Conditions of participation

§ 1 Scope of application

The German Wine Route Marathon with duo and half marathon and the children's and youth run is carried out in accordance with the regulations (IWB) of the German Athletics Association (DLV) and the IAAF under the supervision of the Palatinate Athletics Association e.V. (Kaiserlautern). The organizer is the Bad Dürkheim district, Philipp-Fauth-Straße 11, 67098 Bad Dürkheim.

§ 2 Organization and safety

(1) The organizer will inform participants of organizational measures for organizing the event on the homepage www.marathon-deutsche-weinstrasse.de (runner information) before the start of the event. The instructions of the organizer and its staff or the organizations employed must be followed without fail. In the event of violations that disrupt the proper course of the event or endanger the safety of the other participants, the organizer is entitled to exclude the person concerned from the event and/or disqualify them at any time.

(2) The start number - which is not transferable - must be worn clearly visible and unchanged on the front. To ensure proper timekeeping, the start number must not be folded or used improperly (see transponder handling). The start number must not be given to any other person. If the officially assigned start number is changed in any way, in particular if the advertising print is made invisible or illegible, the participant will be excluded from the time ranking (disqualification).

(3) Timekeeping for all runs is carried out using a transponder attached to the back of the start number.

(4) Participation on other sports equipment and the use of sound devices including headphones is not permitted. Accompanying participants in any form is also not permitted.

(5) Each participant is obliged to assess his or her own health requirements for participation in the event, if necessary after consulting a doctor.

§ 3 Registration - payment terms - other changes and information

(1) Registration is only possible online at www.marathon-deutsche-weinstrasse.de.

(2) The right to start, the organization fees, the payment terms and other organizational basics (participant limit, start documents, re-registration, time measurement, etc.) are shown on the homepage www.marathon-deutsche-weinstrasse.de. In order to be eligible to start, the entry fee must have been received by the organizer.

(3) If a registered participant does not start for whatever reason, there is no entitlement to a refund of the organization fee. Any additional services booked (event T-shirt) expire and will not be refunded. The T-shirt can be picked up on site in the registration tent; it will not be sent by post.

(4) Changing from the marathon to the half marathon during the event is only possible at kilometer 8.7. The organization fee for the originally registered distance will not be refunded.

§ 4 Disclaimer of liability

By registering for the running event, the participant accepts the following disclaimer of liability formulated by the organizer:
(1) Neither the organizer, the sponsors, the hosts or their representatives accept any liability for damage of any kind that may arise to the participant in connection with this event. This also applies to accidents, lost or stored items (e.g. items of clothing), valuables or other items. In particular, the organizer accepts no liability for health risks to the participant in connection with the run. It is the responsibility of the participant to have their state of health thoroughly checked beforehand and to observe the health information provided on the organizer's website (questionnaire for the health check). The participant declares: "I agree that I will receive medical treatment at my own expense during the competition if this should be advisable in the event of injuries in the event of an accident and/or illness during the course of the competition."

(2) If the organizer is entitled to make changes to the conduct of the event or to cancel it due to an official order or for safety reasons in cases of force majeure, the organizer is not liable for damages to the participant. Entry fees collected will not be refunded, subject to the provisions in paragraph 3.

(3) At the time of the announcement, the organizer assumes that the event can be held without special health requirements. To protect the athletes, helpers, spectators and everyone involved, the organizer reserves the right, depending on the development of the health situation, to request official health certificates (proof of vaccination, rapid antigen test) from participants and accompanying persons if necessary. If participants do not provide the certificates, there is no right to participate in the running event and to reimbursement of the entry fee. By registering, participants agree that the organizer is entitled to request appropriate proof from participants at the participants' expense. If the event cannot be held due to the current health situation and/or official order, participants will receive a refund of 60% of the entry fee by bank transfer or Paypal, depending on the payment method. The entry fee consists of the entry fee (60%) and a service fee (40%). The service fee covers the organizer's year-round preparation costs. The service fee for the organization and preparation of the running event will not be refunded, without which the event would not be possible for the organizer in view of the unforeseeable consequences of the Covid-19 pandemic. Paid re-registration fees will not be refunded. Registration fees for the children's / youth runs will also not be refunded. Any T-shirts purchased will be sent to participants by insured mail. The shipping costs incurred in this case amounting to a flat rate of €5 will then be deducted from the refund amount of the entry fee. Participants expressly undertake to follow the organizer's instructions and requirements.

§ 5 Data collection and use

(1) The personal data provided by the participant during registration within the meaning of Art. 4 Paragraph 1 GDPR, including the data necessary for payment processing, will be processed for the purpose of planning, organizing and conducting the event, including medical care. This also includes the publication of start numbers,

running times and result lists. The legal basis for this is Art. 6 Paragraph 1 b) GDPR. The processing of this data is mandatory for participation in the event. In the event of a revocation, participation in the event is not possible. In this case, Section 3 Paragraph 3 applies accordingly. (2) In addition, the participant's personal data will be stored beyond the event in order to inform them about future events and news, among other things. By registering, the participant consents to the data being stored for this purpose.

(3) The participant agrees that the personal data stored in connection with his participation in the event, photos taken, film recordings and interviews in radio, television, print media, books, photomechanical reproductions (films, CDs, electronic data carriers, etc.), including for the purpose of our own advertising, may be passed on, distributed and published without any claim to remuneration, including via the Internet (including the event website, social media, newsletter) and to media for reporting purposes. In particular, the participant agrees to the passing on of his personal data for the purpose of sending photos of the participant on the route and at the finish line, which are produced by a company commissioned by the organizer. However, the participant does not hereby declare that he wishes to purchase such a photo.

(4) The participant also has the following rights with regard to the personal data collected from him: a) Art. 15 GDPR: the right to information about the data stored by us.
b) Art. 16 GDPR: the right to correct incorrect data and to complete incomplete data.
c) Art. 17 GDPR: the right to erasure of personal data, provided there is no legal basis for further storage in accordance with Art. 17 GDPR.
d) Art. 18 GDPR: the right to restrict the processing of personal data.
e) Art. 20 GDPR: the right to data portability, i.e. the right to receive all personal data made available to the organizer in a structured, common and machine-readable format or to request that it be transmitted to another responsible party.

(5) The participant agrees that the personal data collected may be passed on to third parties for the purposes of timekeeping, creating result lists and posting these lists on the Internet.

(6) In addition, the participant agrees to the publication of his first and last name, year of birth, club, start number and results (placement and times) in all event-related print media (participant list, result list, etc.) and in all electronic media such as the Internet.

(7) You have the right to revoke your consent in accordance with sections 2 and 3 at any time for the future without giving reasons. The revocation of the consent does not affect the legality of the processing carried out on the basis of the consent until the revocation.
